These terms are an agreement between you and [BUSINESS NAME] ("we," "us") about the Musikal app and the musikal.io website. By using Musikal you agree to them and to our privacy policy. If you do not agree, please do not use Musikal.
Who may use Musikal
You must be at least [MINIMUM AGE] years old (16 in the EU unless your country sets a lower age) and able to form a binding contract. Musikal is not directed to children under 13.
The service
Musikal shows chords for songs, in time with the music, for piano and guitar players. Some features are free and some need Musikal Pro. We may add, change or remove features, and we may stop offering the service, at any time.
License to the app
We give you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your own non-commercial use. The app is licensed, not sold. Apple's standard Licensed Application End User License Agreement applies to the app. If these terms conflict with it on a point Apple requires, Apple's agreement wins. Apple is not a party to these terms, has no duty to provide support or maintenance for the app, and, if the app fails to meet a warranty, your only remedy from Apple is a refund of the purchase price. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Accounts
An account is optional. You can sign in with Apple, Google, or email and a one-time code. Give accurate information, keep your sign-in methods secure, keep to one account per person, and tell us at [email protected] if you think someone else has used your account. You are responsible for activity under it. You can delete your account in the app under Settings, then Account, then Delete account.
Musikal Pro subscription
- Musikal Pro is an auto-renewing subscription: $3.99 a month or $29.99 a year. Prices may vary by country and can change.
- Free trial. New subscribers may get a 1-week free trial. If you do not cancel at least 24 hours before the trial ends, you are charged for the plan you chose and it renews automatically. Any unused part of a trial is forfeited when you buy a subscription.
- Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Manage or cancel at any time in iOS Settings, under your name and then Subscriptions. Deleting the app or your Musikal account does not cancel it.
- Price changes. If a price rises, Apple will notify you and, where the law requires, ask for your consent. If you do not agree, cancel before the change takes effect.
- Refunds. Apple is the seller and handles all billing and refunds, including any legal right to withdraw from a digital purchase. Request a refund at reportaproblem.apple.com. We cannot issue refunds ourselves.
- Offer codes. Discounts, such as for students and teachers, are redeemed with an Apple offer code and are subject to the terms shown with the offer.
- Taxes. Prices are set and taxes are collected through the App Store.
Acceptable use
Do not misuse the service. That includes trying to break, overload or bypass it, reverse engineering it, scraping it or using bots, reselling it, removing copyright notices, or using it to break the law or infringe anyone's rights.
Chord charts may contain errors
Charts are generated automatically by software and are estimates. They may be wrong, mistimed or incomplete, and we do not promise they are accurate. They are not official transcriptions and are not endorsed by the artists or rights holders. They are a guide for practice and fun, not professional music instruction, and the tuner and Listen mode are likewise not guaranteed to be accurate or to recognize every song. Use your own musical judgment.
Your files
You may import only audio you own or have the right to use and have analyzed, and only for your own personal use. You give us a limited license to process the file to produce its chord chart. We delete the file when the analysis ends and keep only the chart and a file fingerprint, as the privacy policy explains. We do not share your uploaded audio with other users.
Chord corrections and your contributions
When you submit a chord correction, it is shared and can improve the chart for everyone. You are responsible for what you submit and you promise you have the right to submit it. You give us a non-exclusive, worldwide, perpetual, royalty-free, transferable license to host, use, display, adapt and share your corrections, and to combine them with other people's, in Musikal. This continues after you delete your account, with your identity removed. We may moderate, change or remove corrections, and are not obliged to keep any of them. We do not claim ownership of your corrections beyond this license. Any feedback or ideas you send us may be used by us freely without payment.
Lyrics
Lyrics shown under the chords are either added by you or transcribed automatically from the song audio, and may be inaccurate. Lyrics belong to their rights holders. They are for your personal use only. Do not copy, publish, distribute or use them for karaoke or public performance.
Copyright and takedown
Songs, recordings and lyrics belong to their owners. Musikal does not host or distribute commercial recordings. Music and video play from the services below, and imported files stay private to you and are deleted after analysis. If you believe content in Musikal, such as lyrics or a chart, infringes your copyright, send a notice to our designated agent under the Digital Millennium Copyright Act (17 U.S.C. 512(c)):

Your notice should include: your name and contact details; a description of the work you say is infringed; where the material appears in Musikal; a statement that you believe in good faith that the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We remove material that appears to infringe, and may tell the person who supplied it. That person may send a counter-notice with the same kind of details, and we may restore the material if the rights holder does not file a court action within 10 business days. We end access for repeat infringers. Knowingly false notices can carry legal liability.
Third-party content and services
- YouTube. Using the YouTube player in Musikal means you also agree to the YouTube Terms of Service, and Google's handling of data is covered by the Google Privacy Policy.
- SoundCloud. The SoundCloud player is subject to SoundCloud's terms.
- Apple Music. Playback needs your own Apple Music subscription. Musikal Pro unlocks Musikal features only, not music.
- Listen mode. Song recognition is provided by Apple's ShazamKit. We do not promise any song will be recognized. Spotify works only through Listen mode.
These services control their own content and can change or remove it at any time. We do not own or endorse it. Musikal is not affiliated with Spotify, YouTube, Google, Apple or SoundCloud.
Our property
We own the Musikal app, website, chord database, design and brand, apart from your contributions and third-party material. All rights not granted here are reserved. Other companies' names and trademarks belong to them.
No warranty
Musikal is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We do not promise it will be uninterrupted or error free. Some places do not allow certain exclusions, so some of this may not apply to you, and nothing here limits rights you have under mandatory consumer law.
Limitation of liability
To the fullest extent the law allows, we and our owners are not liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing. This does not limit liability that the law does not allow to be limited.
Indemnity
To the extent the law allows, you will defend and cover us against claims, losses and costs that arise from your misuse of Musikal, content you upload or submit, or your breach of these terms.
Suspension and ending
You can stop using Musikal at any time and delete your account in the app. We may suspend or end your access if you break these terms or misuse the service. Parts that by nature should continue, such as licenses to your corrections, disclaimers, liability limits, indemnity and the governing law, survive.
Changes to these terms
We may update these terms. We will post the new version here with a new date and, for material changes, tell you in the app or by email. If you keep using Musikal after a change takes effect, you accept the new terms. If you do not accept, stop using Musikal and cancel any subscription.
Governing law and disputes
These terms are governed by the laws of [STATE], United States, without regard to conflict-of-law rules. Courts located in [STATE] have exclusive jurisdiction over disputes, and you and we consent to them. If you are a consumer in the EU, UK or elsewhere, you also keep any mandatory consumer rights and protections of your home country. Please contact us first at [email protected] and we will try to resolve any issue informally.
Export and government users
You may not use or export Musikal in violation of US export laws or sanctions, or if you are on a US restricted-party list. If you are a US government user, Musikal is commercial software under its commercial license terms.
General
These terms and the privacy policy are our entire agreement with you. If a part is found unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. You may not assign these terms without our consent, but we may assign them. We may give notices by posting them in the app or here, or by email.
